We would like to kindly inform you about planned changes related to the examination of reporting consents (so-called relationships) on behalf of RCs, which result from additional ESMA guidelines in this area. The changes include the introduction of message auth.rlt.001.02 (will replace auth.rlt.001.01), in which an email address tag (EmailAdr) will be added, and the establishment of a dedicated application for confirming reporting consents directly by the RC representative.
The obligation to examine reporting consents stems from Article 1(1)(c) of EU Delegated Regulation 2019/358 (RTS), which is a supplement to Regulation (EU) 2015/2365:
 
„1. A trade repository shall verify all of the following in a received SFT report:
(c) that the report submitting entity, if different from the reporting counterparty as referred to in Field 3 of Table 1 of Annex I to Implementing Regulation (EU) 2019/363, is duly authorised to report on behalf of the reporting counterparty, except in the case provided for in Article 4(3) of Regulation (EU) 2015/2365;”
 
In order to fulfill the above obligation, in accordance with the arrangements with ESMA, the reporting authorization verification procedure designed by the trade repository requires obtaining the counterparty's email address. Obtaining the above data is necessary for the proper implementation of the obligation to verify proper authorization to report on behalf of the counterparty.
KDPW will process the acquired data in accordance with applicable regulations, service regulation and internal procedures and will ensure proper protection.
